Order modified on the law and as modified affirmed without costs in accordance with the following Memorandum: Defendant City of Syracuse (City) contracted with Continental Webb Realty for the construction of a multilevel parking garage. Continental Webb Realty assigned its contractual rights to Webb/St. James Parking Corporation, which ultimately changed its name to Harrison Garage Parking Corp. (HGPC).
