Error to judgment of circuit court of Wise county, rendered September 10, 1892, upon a verdict of a jury convicting the plaintifí in error, M. B. Taylor, of murder iu the first degree of one Ira Mullins, and sentencing him to be hanged by the neck until dead- on December 16, 1892. Opinion states the case.

About 9 or 10 o’clock in the morning of the 14th day of May, 1892 (Saturday), Ira Mullins, a helpless paralytic who had to travel in a wagon, started in a wagon drawn by two horses, and accompanied by his wife and fifteen-year-old son, *111John II.
