NATURE OF THE CASE
This is the second time this case has been before this Court. This case originated as a suit for unpaid charges for goods and services, incurred by the operator, in connection with an oil and gas joint operating agreement. Appellant Tubb first appealed the trial court’s judgment in favor of Appellee Vinson Exploration, Inc. (VEI) in 1991. This Court affirmed in part, reversed in part, and remanded for a new trial on the issues of damages under the Texas Securities Act and set-off amounts. Anderson v.
