At the November term, 1877, of the Putnam *36Circuit Court, the grand jury of said court returned an indictment against the appellee, John V. Morgan, for an alleged felony. This indictment was in two counts. Afterward, at the February term, 1878, of said court, the appellee moved the court to quash each count of said indictment ; which motion was sustained as to the first, and overruled as to the second, count of the indictment.
