Mrs. R. L. Hampton brought suit against the Macon News Printing Company to recover for injuries sustained by her through the negligent operation of a motorcycle by one Gregory Elmore, who, it was alleged, was the agent of the defendant, then and there acting within the scope of his employment in delivering newspapers for the defendant on a rural route. The defendant answered and set up, among its defenses, that Elmore was an independent contractor for whose acts it was not responsible and denied that he was an employee.
