HIRAM CHURCH FORD, Chief Judge.

By this action Hartford Accident and Indemnity Company seeks to recover *420from The Western Fire Insurance Company and The Western Casualty and Surety Company sums expended in defending a personal injury action arising out of an automobile accident and in satisfying the judgment recovered therein by the injured parties.

The basis of the Hartford claim is that at the time of the accident involved the defendants had in effect a policy of insurance covering the same risk as that which was covered by the plaintiff’s policy and that defendants’ insured was primarily…
