I. Background

On or about May 8, 2000, defendants New York State Department of Correctional Services (“DOCS”), Charles Greiner, Superintendent of Sing Sing Correctional Facility (“Greiner”), Corrections Officer Peter Warner (“Warner”), and Corrections Officer Albert Figueroa (“Figueroa”) (collectively, “Defendants”) moved for summary judgment pursuant to Federal Rule of Civil Procedure (“Fed.
