ULRICH, Chief Judge.

Samuel Archuleta appeals his conviction following a bench trial for third degree assault, section 565.070, RSMo 1994, and a suspended six month sentence, two years of probation and forty hours of community service. Mr. Archuleta raises three points of error on appeal.
