Following a bench trial defendant Earl Day was found guilty of the offense of unlawful possession of more than 30 but less than 500 grams of cannabis in violation of section 4(d) of the Cannabis Control Act (Ill. Rev. Stat. 1975, ch. 56%, par. 704(d)). He was sentenced to a term of imprisonment of not less than 1 nor more than 3 years.
