The plaintiff Gillespie is an architect residing at Fargo. The defendant Underwood School District No. 8, is a common school district in the county of McLean. In April, 1920, the plaintiff solicited employment as an architect to prepare plans and specifications for a school building to be built by the district. He went to Underwood and conferred with two members of the school board with respect to the matter of preparing plans and specifications. Some time was spent at this conference.
