This action was brought by the plaintiff, Mary Henze, against John Mitchell and George H. Henze to redeem her *279alleged homestead from alleged tax liens. The petition was filed in the instant case December 15, 1908. It alleged a sheriff’s sale of the premises in controversy to the defendant John Mitchell under a decree of foreclosure describing certain tax liens, and that the decree was void as to the plaintiff for the lack of service upon her.
