— The complaint in this action charges that on or about October 1, 1908, appellant negligently permitted and caused to be gathered on its right of way in section 6, township 35, range 4 west, in Laporte County, Indiana, large quantities of combustible material, and set fire to the same; that appellant negligently permitted said fire to escape from its right of way to other lands in said section 0, south of its right of way, and negligently permitted said fire to escape from said lands to the lands of one Nicholas W.
