This action is for the recovery of the value of certain personal property, money, and checks which were taken and carried away by the defendant, R. N. Andrew, on June 20, 1914. The defendant admits the taking, but says that as deputy sheriff without warrant, he isejized the .property in question ¡together with other articles of personal property and large quantities of liquor and beer. His plea justified the taking on the ground that as deputy sheriff of Payne county, he lawfully seized the property in question, same being at the time used in violating the laws of Oklahoma,…
