This case originated in the district court in and for Woods connty at the May term, 1897. Several assignments of error are urged by the plaintiff in error for a reversal of this case, but we think it only necessary to refer to one, viz., that the court committed- error in overruling the demurrer to the indictment. By the laws of this Territory, as amended by the act of 1895, p. 104, rape is defined as follows:
“Eape is an act of sexual intercourse accomplished with a female, not the wife of the perpetrator, under either of the following circumstances:
