Burford, C. J.:

A prosecution was begun in the district court of Woods county against John Young for assault with intent to commit the crime of rape. The defendant was found guilty, and sentenced to serve a term of four years in the penitentiary. A demurrer was interposed to the indictment, which was overruled, and exception saved. After verdict a motion was presented in arrest of judgment, which was overruled, and excepted to by the defendant. Both the demurrer and the motion in arrest of judgment test the sufficiency of the fact stated to charge a public offense. The…
