Appeal from an order of the Supreme Court, Erie County *1195(Marjorie C. Mix, J.H.O.), entered April 11, 2003. The order granted defendant’s motion to compel the Town of Cheektowaga and the Cheektowaga Police Department to produce the police personnel/internal affairs file of plaintiff.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs.
