Memorandum.
The order of the Appellate Division should be affirmed, with costs.
In this action for damages for libel, plaintiffs and defendants both sought under CPLR 3101 (subd [a], par 4) and CPLR 3120 (subd [b]) disclosure of confidential investigative reports of the nonparty respondent concerning police scandals which occurred in 1972.
