Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Saratoga County) to review a determination of the Commissioner of the Fulton County Department of Social Services, which dismissed petitioner from his employment. In April, 1980 the petitioner was suspended without pay from his job as a cleaner at the Fulton County Infirmary pending the determination of misconduct charges preferred against him by Ronald W.
