Mr. Chief Justice Drew,.This appeal is from an order of Court of Common Pleas No. 1 of Philadelphia County sustaining preliminary objection of William M. Strunk, one of defendants, to plaintiff’s complaint in assumpsit. The objection was in the nature of a petition to set aside the service of civil process as to Strunk on the ground that he was immune from such service at the time it was made.
