H. W. Powell, doing business under the name of Powell Fuel Company, on the petition of certain of his creditors, was duly adjudged a bankrupt by the United States District Court for the Eastern District of South Carolina. T. C. Cross was appointed trustee of the bankrupt estate, and, as such, is the plaintiff-appellant in this action.

The suit is brought under the provisions of the Bankruptcy Taw (11 USCA). The complaint alleged that within four months prior to the date of the filing of the petition in bankruptcy, and while insolvent…
