This is a product liability action wherein plaintiff seeks to recover punitive damages in addition to compensatory damages in the sum of $2,408,415.91. Of this amount, plaintiffs have already received $2,400,-915.91 from their insurance carrier, National Union Insurance Company of Pittsburgh (“National Union”), which is, under the applicable law of the Commonwealth of Penn*337sylvania, subrogated to plaintiffs’ claims to the extent of the payments they have made.
