J., (after stating the facts as above.) —Owing to the order in which the different assignments of errors are argued and the manner in which they are presented in the several briefs filed by the plaintiff in error, the defendant in the court below, we have found it difficult to determine just what asignments of error are insisted *333upon and what assignments may be deemed to be abandoned for failure to argue them.
