A jury convicted Ali Ahmed Sheikh (Sheikh) of (1) conspiracy to possess with intent to distribute a substance containing cathinone, a Schedule I controlled substance, and cathine, a Schedule IV controlled substance, in violation of 21 U.S.C. §§ 841(a)(1) & 846 (2000); (2) possession with intent to distribute the same controlled substances, in violation of 21 U.S.C. § 841(a)(1); and (3) using a communication facility in causing and facilitating the commission of a felony under the Controlled Substances Act (CSA), in violation of 21 U.S.C. § 843(b) and 18 U.S.C. § 2.
