This appeal stems from a class action suit against the City of Dallas. Jim Low-enberg, on behalf of himself and a certified class of all others similarly situated, (the plaintiffs) sued the City seeking a declaration that a fire safety registration fee assessed against owners and operators of commercial buildings was unconstitutional. The plaintiffs also sought a refund of those fees plus additional attorney’s fees. Both sides moved for summary judgment.
