This is an action brought by the assignee in insolvency of Webster and King, silk manufacturers, to recover the value of property transferred by them to the defendant shortly before they were put into insolvency in February, 1888. The main controvei’sy concerned two bales of silk delivered to the *65defendant on January 14, 1888. Before that time Webster and King had aslced the defendant to accept a voluntary assignment for the benefit of creditors, and on December 24, 1887, they had made an assignment to him, and had put it on record.
