Thiele, J.:

This was an action to recover damages for alleged unskillful acts and lack of proper care in the performance of a dental operation. During the course of the trial the defendant demurred to the plaintiff’s evidence, the demurrer being overruled. At the close of the trial the defendant moved the court to instruct the jury to return a verdict in his favor, this motion being denied. Thereafter the court duly instructed the jury, and it returned a verdict in favor of the plaintiff. Defendant’s motion for a new trial was denied and judgment was…
