OPINION

NYE, Chief Justice.

This is a summary judgment case. The plaintiff, Alfredo A. Garcia, was convicted in the 197th Judicial District Court of Cam eron County, Texas, of the offense of “a felon in possession of a firearm.” The appellant was sentenced under Section 12.-42(d) of Vernon’s Annotated Penal Code to life imprisonment as a habitual criminal. The defendant was the appellant’s attorney in the criminal case.
