Appeals (1) from a judgment of the Supreme Court (Lamont, J.), rendered April 1, 2004 in Adbany County, upon a verdict convicting defendant of the crimes of robbery in the second degree and criminal possession of stolen property in the fourth degree, and (2) by permission, from an order of said court, entered August 20, 2007 in Albany County, which denied defendant’s motion pursuant to CPL 440.10 to vacate the judgment of conviction, without a hearing.
