This action was brought by respondent against appellant, the city of Seattle, to recover damages for injuries alleged to have been received through the negligence 'of appellant. The negligence charged is that:of permitting a trench to be uncovered, unguarded, and without lights or signals of danger on that part of Twenty-fourth avenue where the same intersects with East Howell street in said city.
