MERRITT, Circuit Judge.

This criminal appeal raises statute of limitation issues. It is an appeal by the Justice Department from the grant of a motion to dismiss two counts of a six-count indictment. District Judge Wilhoit in a well-reasoned opinion dismissed Count I (conspiracy to obstruct justice in violation of 18 U.S.C. §§ 371, 1503) and Count III (obstruction of justice in violation of § 1503).
