Dawson, J.:
This was an action of tort for injuries sustained by the plaintiff and .to his property when his automobile was run into from the fear by defendant’s street car.
The plaintiff pleaded divers physical injuries, pain and suffering, loss of time and loss of wages, and other elements of damage including $750 damages to his automobile.
The verdict and certain special findings read:
“We the jury find for the plaintiff and assess his damages at $3,500.
“$3,000 for injury.
“$500 for car.”
