¶ 1. Douglas Cain filed a workers' compensation claim against his employer Jesco, Inc., and its insurance carrier, Zurich American Insurance Company, for injuries sustained when he was hit by a car. On the bifurcated issue of compensability, the Workers' Compensation Commission ruled in Cain's favor. The Lee County Circuit Court affirmed the Commission's decision and remanded the case to determine Cain's benefits. Jesco appeals and argues that: (1) Cain did not receive his injuries in the course and scope of his employment, and (2) no exceptions to the "going and coming" rule apply. We find…
