The defendant, Joel Olivera (Olivera), and codefendant, Jorge Vargas (Vargas), were charged by indictment with the offenses of first degree murder and armed violence for their respective roles in the fatal shooting of Raphael Torres on July 29, 1988. Following a jury trial, Olivera was convicted of first degree murder and sentenced to 35 years in the Illinois Department of Corrections.
