Appeal from an order of the County Court of Ulster County (Vogt, J.), entered May 28, 1993, which granted defendant’s motion to dismiss the indictment.

On the morning of August 13, 1992, 17-year-old Cindy Manon found her two-month-old son, Kenneth, dead in his crib; an autopsy revealed the cause of death to be severe dehydration and malnutrition.
