This action was brought by Sanders and Will Stith against the Beaumont Cotton Oil Blill Company upon an alleged breach of contract, providing for the sale of three cars of cotton seed at. $40 per ton, f. o. b. Lawn, Tex., and for special damages. The defendant answered that the Railroad Commission of Texas had fixed a carload of cotton seed at 10 tons, and that it was so fixed by the custom among shippers and dealers in cotton seed, and that defendant had instructed plaintiffs not to ship more than 15 tons per car before plaintiffs had loaded the car, secured bill of lading, and…
