KANNE, Circuit Judge.

Zvonko Stepanovic is a citizen of Serbia and Montenegro 1 who faces removal from the United States. He seeks review of an order of the Board of Immigration Appeals declaring him ineligible for cancellation of removal pursuant to the battered spouse provision of the Immigration and Nationality Act § 240A(b)(2), 8 U.S.C. § 1229b(b)(2). The government contends that this court lacks jurisdiction to review the BIA’s determination that Stepanovic was not subjected to “extreme cruelty” under § 1229b(b)(2).
