This is an action by the Glenn E. Smith Company, a co-partnership, as plaintiffs, to recover from the United States Fidelity & Guaranty Company expenses of litigation, including attorney’s fees, incurred in defending a civil action brought against such Smith company and others in the district court for Burt county, Nebraska, by one Dollie Spiel-man.
