This is an action of trespass to try title to lot No. 12 in block No. 3, corner of Matamoras and San Saba streets, city of San Antonio, instituted by William Gembler against William Simang and Anton Weinert. In addition to pleading the statutory matters required, Gembler alleged that he claimed title to the land through a sheriff’s sale of date July 11, 1896, which was made by virtue of an execution issued under a judgment held by Gembler against William Simang, and he alleged that appellant was claiming the land through a deed made to him by William Simang, which deed…
