This is an indictment against William Henry Terry Langhorne, the prisoner, for the felonious and malicious burning a tobacco factory, the property of Robert F. Robertson, which, with the property therein contained, was of the value of §30,000.
There was a demurrer to the indictment, which was overruled by the court, and the prisoner pleaded not guilty; upon which plea issue was joined. A jury was impaneled and sworn, and charged by the clerk under § 3 of ch. 3 of *1014the Acts of the General Assembly of 1877-8.
