This case was tried on stipulated facts before a judge of the Oakland County Circuit Court, sitting without a jury. The order of events at trial is rather interesting. Plaintiffs counsel first gave an opening statement, and the attorneys for the other two parties stipulated to the facts as set forth by plaintiffs counsel. Following this stipulation, plaintiffs counsel delivered a closing argument, followed immediately by the trial court’s rendition of an opinion from the bench. The court therein decided to enter a judgment of no cause for action on behalf of the defendants. Plaintiff appeals.
