This matter comes before the court on the motion of defendant Eagle Manufacturing Company (hereinafter “Eagle Manufacturing”) for summary judgment. Defendant contends that its product, a gasoline can, was not defective as a matter of law because it complied with administrative regulatory safety standards in designing and manufacturing the can. Eagle Manufacturing claims it had no duty to warn plaintiff, because any danger associated with use of its product was open and obvious.
