MEMORANDUM OPINION

BROWN, District Judge.

This matter comes before the Court on the plaintiffs and defendants’ cross-motions for summary judgment pursuant to Fed.R.Civ.P. 56. Plaintiff also moves for a continuance pending discovery as to defendants’ motion for summary judgment, pursuant to Fed. R.Cxv.P. 56(f). For the reasons set forth in this Memorandum Opinion, the Court will grant in part and deny in part defendants’ summary judgment motion, grant in part and deny in part plaintiffs summary judgment motion, and deny as moot plaintiffs motion for a continuance.
