On July 8, 1904, John Suta sued out a summons from the City Court of Aurora against the Chicago, Burlington and Quincy Railway Company (hereinafter called the railway company), returnable on the third Monday of September, 1904, in an action of trespass on the case, which summons was duly served and filed.
