A. Factual Background

This case arose from the January 21, 2001 shooting death of Jaime Dvorak. On January 21, 2001, Police Officer Craig Ziemba, Reading Police Department, in the City of Reading, Berks County, Pennsylvania, was on patrol when he got a call to respond to a shooting at 1259 North 10th Street in Reading.1 Upon Officer Ziemba’s arrival at the scene just before noon, Jaime Dvorak (the victim), had already been pronounced dead by ambulance personnel.
