MEMORANDUM OPINION
HILTON, Chief Judge.
This matter comes before the Court on Plaintiffs motion for partial summary judgment, Defendant’s motion for summary judgment and Defendant’s cross-motion for partial summary judgment on its federal preemption affirmative defense.
Plaintiff and Defendant are competing corporations in the business of electrical service contracting. Thaddeus Gerardi (hereinafter “Gerardi”), was hired by the Plaintiff as an apprentice electrician in 1971.
