Potter, Justice.

This cause is here on direct appeal; that being the name given to the proceeding by the statute providing for it as a separate and independent method for the review of a judgment or final order of a district court, leaving the proceeding in error undisturbed and expressly continuing in force the then existing statutory provisions relating thereto. Laws 1917, Ch. 32; Comp. Stat. 1920, Sections 6401, 6415. And the cause has been heard upon a motion to dismiss the appeal.
