INTRODUCTION

The plaintiffs, Lydia D. (“Lydia”) and Andrew T. (“Andrew”), (collectively “the plaintiffs” or “the children”), brought this action after they were ordered to leave3 Boston Latin School (“BLS”) on Wednesday, December 3, 2003, based on the defendants’ determination that the children do not “actually live” in Boston.
