THOMSEN, District Judge, sitting by designation.

This is an action for treble damages under the antitrust laws brought against Ford Motor Company by a former Lincoln-Mercury dealer at Winston-Salem, N. C. No claim is made based upon any breach of contract or other cause of action except the alleged violation of the antitrust laws.

The complaint is elaborate and was amended twice before trial; so amended, it sets up six causes of action, alleges that all acts complained of in the several causes of action were done in furtherance of the conspiracy alleged in the first cause of action, and that…
