In the Court below Thomas H. Brayshaw filed his petition, in which he alleged:

1st. That St. Margaret’s (Westminster) Parish in Anne *455Arundel county is one of the parishes of the Protestant Episcopal Church of the United States in the diocese of Maryland, established under the provisions of the Act of the General Assembly of Maryland of the year 1798, entitled “An Act for the establishment of vestries for each parish in this State.”

2nd. That he is a free white male citizen of the State of Maryland, thirty-three years of age, and is now, and for more than two years has been a resident of said…
