Appeal by the defendant from a judgment of the Supreme Court, Kings County (Schneier, J.), rendered April 9, 1984, convicting him of criminal possession of a controlled substance in the third degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is modified, on the law and the facts and as a matter of discretion in the interest of justice, by reducing the conviction of criminal possession of a controlled substance in the third degree to a conviction of criminal possession of a controlled substance in the seventh degree, and vacating the sentence imposed.
